It is not permitted at any time to use the application to send Spam. MailTemple will immediately intervene if we suspect that this is the case.
MailTemple observes all campaigns that are sent to big emailing lists. If it seems that a user is guilty of spaming, MailTemple reserves the right to directly remove the user out of our system without breaking the contract and without any return of money. Any costs that MailTemple will have to face will be fully repaid by the user.
If the user imports his mailing list to MailTemple, the user has to go accord with these terms:
- The mailing list is composed out of email addresses of which the owner has explicitly and perceivable agreed on receiving email campaigns.
- The mailing list has not been bought or rented by a third party.
- If the campaign is reported as spam. MailTemple reserves the right to close the account.
What is SPAM?
Spam is defined as Unsolicited Bulk E-mail (UBE), in other words: emails that are sent in a massive number (bulk) and unsolicited. This means, if large amounts of emails are sent to recipients that have not explicitly agreed on receiving this email, it can be seen as spam.
European regulation
This regulation says that European companies have to use the opt-in system when email campaigns and email marketing are used for a commercial goal. They only have the right to send emails to email addresses for which agreement has been given.
What is Opt-in en Opt-out?
Opt-in means that the owner of an email address has explicitly agreed on receiving an email of a specific mailing list. The consent is not transferable. This can be verified by the use of a confirmed opt-in, also called double opt-in. After having signed up, the owner of the email address receives a confirmation mail, with the question whether he really wants to sign up for the mailing list. If the owner of the email address doesn't send the request back, it will be assumed that someone else signed the email address up (or that the owner changed his mind). If the owner of the email address does confirm the request, he explicitly confirms that he agrees on receiving emails from the mailing list. MailTemple's sign-up form can then be seen as an opt-in registration.
Opt-out means that the receiver of the campaign can sign out of the mailing list. Each email that is sent out by MailTemple has automatically this link.
